Consular Assistance

When travelling overseas, you should always register with your countries embassy, high commission or consulate. This helps if you need to be located while abroad. If you find yourself in some sort of legal trouble or immigration problem your consulate representatives may be able to assist you in finding representation or advising on your position. It is important to note they are not there to post bail for you. Consulate representatives can get in contact with family members for you and they can help organise the correct processes for you and your family to follow in regards to the legal standing and process for posting bail.

It is important to note that a consulate member of staff cannot assist in or intervene in foreign countries laws. If you have been being brought before a court or arrested that country legal channel is what applies not your country of origins legal system.

Remember you are in a different country, as a resident of that country even if you are on a working holiday visa you must obey and follow that countries rule of law.

In very delicate and difficult situations when a foreign national is being held in custody you do have the right to contact your consulate for advice and assistance. Again this will be determined by the country you are in, but generally your consulate will to speak you a confidence manner.

If there is an issue resulting in deportation your consulate will work with the local authorities to assist your extradition or deportation. Deportation will most likely result in being returned to your country of origin.

The consulate may upon request and under certain circumstances hold your passport if you are in placed into custody. Again you need to speak to the consulate directly should you be in this position.
